The case was filed against private equity firm, HIG Capital, and former executives of South Bay Mental Health Center, Inc. after a whistleblower reported that South Bay was submitting fraudulent claims to the State’s Medicaid program, MassHealth. Between 2009 and 2017, South Bay received over $125 million from MassHealth as a result of its false claims.

The case recently ended in the largest settlement of its kind. “The $25 million False Claims Act settlement is reportedly the largest to date in which a private equity firm has paid to resolve allegations of health care fraud by one of its portfolio companies,” a Massachusetts Lawyers Weekly staff member said in December. “The settlement is also reportedly one of the largest FCA settlements involving allegations of fraudulent billing for mental health services.”
